Builders Meet on Pre-Payment of Connection Fees

Builders League members met on March 23 to discuss a possible course of action to end the practice of some municipal and municipal utilities authorities that require the payment of connection fees prior to actual connection in order to get a Treatment Works Approval. Clayton, Woodstown, Mt. Laurel, Moorestown, Vineland and East Windsor were towns that builders had informed BLSJ were imposing the pre-payment condition. Because builders often apply for multiple sewer connections at one time, a pre-payment provision will require payment of connection fees well in advance of the actual physical connections and in some cases years in advance. This can result in a significant financial burden to builders.

What Remodelers Need to Know About the EPA's Lead Paint Rule

The U.S. Environmental Protection Agency’s Lead: Renovation, Repair and Painting rule governing the work of professional remodelers in homes where there is lead-based paint was published in the Federal Register on Earth Day, April 22. The rule will take effect in April 2010. Beginning in April 2010, firms working in pre-1978 homes will need to be certified. Along with the firm certification, an employee will also need to be certified as a Certified Renovator. http://www.nahb.org/generic.aspx?genericContentID=118467. Violations of this new rule can result in fines of $32,000 per day. The Builders League is offering a One-Day EPA Lead Certification Course on May 20 3 at the Builders League office. Sample Contract Language Available for Members for EPA Lead Paint Rule

Attorneys for the National Association of Home Builders have drafted new contract language for remodelers and home improvement contractors, who have taken the Lead Paint Certification training, to use in their contracts. As of April 22, the Environmental Protection Administration will require all contractors working in homes built before lead paint was banned in 1978 to be trained and certified under the Lead Paint: Renovation, Repair and Painting rule (LRRP). Contractors subject to the rule include remodelers, carpenters, plumbers, heating and air conditioning workers, window installers and others.
